A Lasting Power of Attorney (LPA) is a legal document that allows someone to make decisions for you or act on your behalf if you are no longer able to make decisions, including in circumstances such as where following an accident or illness you lack mental capacity. There are two different types of Lasting Power, one for Property and Financial Affairs and another for Health and Personal Welfare. You can choose to enter into one or both types of Lasting Power.
Our charges for assisting with the preparation and registration of one Lasting Power (either type) are £425.00 plus VAT at 20%. Should you wish to have both types of Lasting Power or for joint instructions (e.g. husband and wife/civil partners for one type of Lasting Power) our charges are £625.00 plus VAT at 20%. Should you wish to have four Lasting Powers prepared (two of each type for two people) (e.g. for husband and wife/civil partners) our charges are £1,000.00 plus VAT at 20%.
The Process
- You contact us to advise you would like us to assist you with the preparation and registration of Lasting Power of Attorney.
- We will send you out an initial letter with our client care letter, a questionnaire for completion and our initial letter of advice.
- We prepare the draft paperwork and then invite you into the office to go through the forms.
- We advise you on the implications of entering into the Lasting Power of Attorney and give a certificate as to your mental capacity.
- We arrange for your attorneys to counter-sign the Lasting Power; the application for registration is made to the Office of the Public Guardian.
- Once we have heard back from the Office of the Public Guardian with confirmation of registration, we write to you with the registered documents and supply a certified copy for future use.
We can complete our part of the work within a few weeks. You should allow registration of the Office of the Public Guardian to take several months.
